KEVIN J. O'CONNOR is a member of the firm's Litigation Group and concentrates his practice in civil litigation and appeals in state and federal court. He has been recognized as a "New Jersey SuperLawyer" in Business Litigation for the years 2008, 2009 and 2010 by Law & Politics and the publishers of New Jersey Monthly Magazine. Mr. O'Connor concentrates his practice in the following areas:

Appellate Practice representation of litigants in appeals before the New Jersey Supreme Court and Appellate Division and U.S. Court of Appeals, including plenary appeals, emergent appeals and interlocutory appeals, petitions for certification and representing Amicus Curiae.  

Commercial and Business Litigation
representation of clients in a broad range of business and corporate matters including contract disputes, class action litigation, intellectual property litigation, collection actions, distributorship agreements, oppressed minority shareholder actions, specific performance and chancery matters. 

Eminent Domain and Condemnation Law representation of property owners, tenants and condemning bodies in all facets of eminent domain matters, including valuation of fair market value; disputes as to public use and bad faith condemnation, inverse condemnation, redevelopments zones, relocation benefits, and disputes as to allocation of awards. 

Land Use Law and Litigation representation of property owners, applicants and local boards in prerogative writ litigation and civil rights claims involving applications for development and restrictions on property usage.  

Life, Health and Disability Law representation of clients in litigation involving coverage and denial of benefits under ERISA benefit plans and individual policies, bad faith litigation, misrepresentation and rescission, agent error and defalcation, interpleader, HIPAA compliance issues, HCQIA and the National Practitioner Data Base.  

          

Mr. O'Connor received his undergraduate degree in Political Science from the University of Richmond and his JD degree, cum laude from Seton Hall University School of Law in 1991, where he was a member and associate editor for the Seton Hall Law Review.  During law school, he served as a summer judicial intern for the Hon. Maryanne T. Barry of the U.S. District Court for the District of New Jersey.  After law school, Mr. O'Connor served as the judicial law clerk for the Hon. Herman D. Michels, the Presiding Judge for Administration of the Superior Court of New Jersey, Appellate Division before joining the Firm. 

 

In addition to the foregoing practice areas, Mr. O'Connor has served as a member of the Editorial Board for New Jersey Lawyer Magazine and is currently a Member of the New Jersey Supreme Court District Ethics Committee, District V-A. Mr. O'Connor has been honored as a fellow of the Litigation Counsel of America, Trial Lawyer Honor Society.
